Terms and Conditions

These Terms of Service ("Terms") govern your use of PLOOQ (plooq.com, "the Service"), currently operated by Petru Dimulescu as an individual. By using PLOOQ, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Overview

PLOOQ allows users to upload and submit content (text, audio, video, images) for AI-powered processing and to send communications (emails, texts, WhatsApp) on their behalf, subject to consent requirements. Users may select their preferred AI provider, or use the default provider chosen by PLOOQ.

All application workloads and data storage are located in the EU, primarily using Heroku and AWS infrastructure. Our database is hosted on AWS in the EU region.

Cookies & Session Management

PLOOQ uses a session cookie to identify you and maintain your login session. This cookie is essential for the operation of the service and does not track you for advertising or analytics purposes. By using PLOOQ, you consent to the use of this cookie. If additional cookies are introduced, we will update our policies accordingly.

2. Acceptable Use

• No illegal, abusive, or harmful activity, including but not limited to any activity that violates local, national, or international law.
• No uploading, sharing, or generating of pornographic, sexually explicit, obscene, or exploitative content.
• No harassment, hate speech, threats, bullying, or abuse of any kind.
• No spamming, phishing, or unsolicited messaging; you must have a prior relationship with recipients and obtain their explicit consent.
• No infringement of third-party rights, including intellectual property, privacy, or publicity rights.
• No attempts to disrupt, compromise, or gain unauthorized access to the Service, its infrastructure, or other users' accounts.
• No uploading or sharing of content related to terrorism, violence, weapons, or other high-risk or dangerous activities.
• No use of the Service for money laundering, fraud, scams, or any other financial crime.
• No use of the Service for distributing malware, viruses, or malicious code.
• No use of the Service for any activity that could cause harm to minors or vulnerable individuals.
• No use of the Service for any activity that could reasonably be considered high-risk, dangerous, or criminal.

Violation of these rules may result in immediate suspension or termination of your account. We reserve the right to delete content, suspend accounts, and report users to law enforcement authorities if we believe illegal or high-risk activities have occurred.

3. User Obligations

• You are responsible for the content you upload and for ensuring you have the right to share any personal data, including recipient information
• You must obtain explicit consent from recipients before sending communications via PLOOQ
• You must not use the Service for unlawful or unauthorized purposes

4. AI Processing, Provider Choice & Limitations

PLOOQ uses AI to process content and generate actions, routed via Requesty. You may select your preferred AI provider, or use the default. AI outputs may not always be accurate or appropriate. You are responsible for reviewing and approving any actions or communications generated by the Service.

5. PII Obfuscation Disclaimer

We aim to obfuscate and tokenize all PII (such as emails and phone numbers) before AI processing. However, due to the unstructured nature of user input, we cannot guarantee that all PII will be correctly identified and obfuscated. By using PLOOQ, you acknowledge and accept this limitation.

6. Service Availability

We strive to provide reliable service but do not guarantee uptime or uninterrupted access. The Service may be suspended or modified at any time.

7. Content Ownership & License

You retain ownership of your content. By using PLOOQ, you grant us a license to process, store, and use your content as necessary to provide the Service.

8. Limitation of Liability

The PLOOQ service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, PLOOQ and Petru Dimulescu expressly disclaim all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. By using PLOOQ, you acknowledge and agree that:

• AI Output: The service uses AI to process your data and generate outputs. We do not guarantee the accuracy, completeness, or appropriateness of any AI-generated content. You are solely responsible for reviewing and using such content.
• User Decisions: You are responsible for any decisions or actions you take based on the service or its outputs.
• Data Loss or Corruption: We are not liable for any loss, deletion, or corruption of your data, whether due to technical issues, user error, or third-party failures.
• Service Availability: We do not guarantee uninterrupted or error-free service. The service may be unavailable due to maintenance, outages, or other reasons.
• Security Breaches: While we take reasonable measures to protect your data, we are not liable for unauthorized access, hacking, or other security incidents beyond our control.
• Third-Party Services: We are not responsible for issues arising from subprocessors, AI providers, or other third-party services integrated with or used by PLOOQ.
• Legal Compliance: You are responsible for ensuring your use of the service complies with all applicable laws and regulations, including data protection and consent requirements.
• Consequential, Indirect, or Incidental Damages: We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
• User Content: We are not liable for the content you upload, submit, or share, including any infringement, illegality, or harm caused by such content.
• PII Obfuscation Limitations: While we aim to obfuscate personally identifiable information (PII) before AI processing, we cannot guarantee all PII will be identified and obfuscated.
• Account Security: You are responsible for maintaining the security of your account and password.
• Force Majeure: We are not liable for failures or delays due to events outside our reasonable control (e.g., natural disasters, war, internet outages).

In no event shall PLOOQ or Petru Dimulescu be liable for any damages arising out of or in connection with your use of the service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages. Your sole and exclusive remedy for dissatisfaction with the service is to stop using PLOOQ.

9. Indemnity

You agree to indemnify and hold harmless PLOOQ and Petru Dimulescu from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

11. Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
